Section 11.03(5) of the <br /> Shoreland Ordinance, Dane County Code of Ordinances, allows a maximum of 200 square fee Minor <br /> Structures" located between a line 35 feet landward from the Ordinary High Water Mark and t e house. This has <br /> been interpreted by the Dane County Zoning Division and the Wisconsin Department of Natura&Resources to <br /> include all "structures" constructed with impervious surfaces, including at-grade patios of any type. <br /> It appears that the patio shown on your plan does not exceed the maximum 200 square feet(SF). However, the <br /> photos taken at the Board of Adjustment site visit on August 14, 2008 show a fire pit located on the lake side of <br /> the "old" house. The fire pit would also be considered a Minor Structure. Has it been removed? If not, the area <br /> of the at-grade deck and the fire pit combined may not exceed 200 SF. <br /> Your description of what's shown on the site plan as a "Proposed Deck" makes me wonder what type of <br /> construction you propose, since any deck that you need to "step up on" is not permitted. Could you please <br /> describe the material and methods of construction for the"deck?" <br /> When I am satisfied that the deck/patio you propose meets the Shoreland Ordinance Minor Structures provisions, <br /> I'll place the revised site plan showing the deck in your Zoning Permit 2008-0677 file, with a signed, dated note <br /> indicating my approval .
