1104 Highway 138 South <br /> Stoughton, Wi. 53589 <br /> February 9, 1984 <br /> Ms. Mary Weisensel, Chairperson <br /> Agriculture, Environment $ Zoning Committee <br /> c/o Dane County Zoning Department <br /> Room 116 City-County Building <br /> Madison, Wisconsin 53709 <br /> Dear Ms. Weisensel and Committee Members: <br /> This letter is in regard to proposed rezoning petition #3185. I would prefer to be <br /> present at the February 14th meeting as I was at the Dunkirk Town Board meeting <br /> but a conflict in schedule prevents me from doing so. Therefore, I hope to <br /> express my view, which coincides with the Dunkirk Town Board's unanimous decision, <br /> in opposition to the petition. <br /> I provided a chart to the Dunkirk Town Board (copy attached) which provided <br /> supplemental information to that gathered by the Town's planning commission <br /> during an on-site visit. While I do not claim to be a surveyor I believe the <br /> measurements are sufficiently accurate to illustrate my primary reasons for <br /> opposition. <br /> First, I believe the area is too small to support horses (which RH-1 would allow) <br /> or other livestock. Previous experience has shown that the area fenced for pasture <br /> and corral will be eaten bare by even one horse. The area is less than one acre. <br /> Confining a horse in the corral in an attempt to allow the grass in the pasture <br /> to grow back results in a situation with manure, odor, and flies that I don't <br /> wish to experience again. I would also argue that if discounts were made for the <br /> driveway easement and the pond, which is not indicated on the public hearing <br /> notice, that the two acre minimum for RH-1 zoning might not be met. <br /> Second, I am concerned on health grounds because the western boundary of the parcel <br /> in question is only 15 feet from my well. The barn is 27 feet from the boundary <br /> while 50 feet is the minimum for conformance. The barn is then 42 feet from my <br /> well. The barn is also closer to my house, 69 feet, than to the Kalal house, 95 <br /> feet. <br /> Finally, since there is no livestock on the property at this time there are no <br /> sentimental or personal reasons to support the petition. In fact, there is no <br /> livestock in the entire neighborhood illustrated on the hearing notice. This is <br /> a residental neighborhood. I urge you to adopt the Dunkirk Town Board's <br /> recommendation to deny rezoning from A-1 Ex. to RH-1. <br /> Respectfully, <br /> Russell Heilman <br /> cc: Kathleen Soderbloom <br />
