See the enclosed copy, Item #7. <br /> The proposed Lot#3 is located in an RH-1 District which provides that the mini- <br /> mum lot area is 2 acres. Lot#3 is less than 1 acre and therefore does not com- <br /> ply with the requirements of. the R11-1 District. Appropriate zoning, other than <br /> RH-1, would lie necessary to permit the creation of Lot #3. <br /> Likewise, revision of the CSM to provide complying lot sizes for Lots 2 and 3, <br /> recording of the CSM and subsequently transfering land from Lot #3 to Lot #2 <br /> which would reduce the Lot #3 area to less than 2 acres is also not permitted. <br /> Section 10.04 (5) - Dane County Zoning Ordinance - pertaining to open space <br /> limitations provides --- No lot area shall be so reduced or diminished that <br /> the yard or other space shall be smaller than prescribed by this chapter. There- <br /> fore, a land transfer such as described would be in violation of the requirements <br /> of the Zoning Ordinance. <br /> You have also questioned how Lot #1 of this CSM could be allowed to remain in <br /> the A-1 Exclusive District when it does not comply with the minimum 35 acres re- <br /> quired by A-1 Exclusive. This is permitted because the property is intended to <br /> remain a part of the main cropland of the farm which is over 35 acres in area. <br /> A more detailed explanation is included in the enclosed "King” letter.
