• <br /> 1831178 <br /> DECLARATION OF COVENANTS <br /> WHEREAS, Park Village Associates , a Wisconsin limited <br /> partnership, is the owner of certain lands located in the <br /> Town of Madison, County of Dane, State of Wisconsin, more <br /> particularly described on Exhibit A hereto (the "Property" ) ; <br /> and <br /> WHEREAS, the Town of Madison and Park Village Associates <br /> desire that the Property, so long as it is used as an apart- <br /> ment complex, shall not include more than 343 apartment <br /> units (including 86 two-bedroom units) . <br /> NOW THEREFORE, Park Village Associates , for good and <br /> valuable consideration, hereby declares and provides that <br /> the Property shall be subject to the following covenants: <br /> 1. Park Village Associates hereby covenants and <br /> agrees with the Town of Madison, its successors and assigns <br /> that the Property, so long as it is used as an apartment <br /> complex, shall not include more than 343 total apartment <br /> units, of which no more than 86 may be two-bedroom units. <br /> 2. The burden of this convenant shall run with the <br /> land and shall bind Park Village Associates, its successors <br /> and assigns. <br /> 3. This covenant shall be enforceable only by the <br /> Town of Madison and its successors and assigns , including <br /> RECEIVED <br /> MAY 041984 <br /> DANE COUNTY <br /> ZONING DEPT. <br />
