All uses on the subject property shall be held in accordance with all provisions of the deed restrictions of record at the Dane County Register of Deeds office, recorded at Records, Volume 6039 , Page 1, as document No. 1849050 which document is incorporated herein in its entirety as if fully set forth, except as otherwise provided herein. 2. As used herein and as used in the referenced deed restrictions, the following definitions shall apply: Facilities The entire premises including all land and accessory structures. Facilities Closed Vacated by the public. Public All natural persons except track personnel as defined herein. Racing Season April 1st thru Oct. 31st. Secured Gates Closed to public access but not necessarily locked. Track Personnel All persons involved in organizing or producing the race, including pit crews and other race associated personnel, other than spectators. 3. Racing events held outside the racing season as defined above shall conform with all other conditions herein stated and in addition shall require prior approval of the Committee, with notice to the Town Board of the Town of Rutland. Approval will not be unreasonably withheld. 4. Warzyn Plan #MC-204188-2, dated September 26, 1984, is incorporated herein in its entirety as if fully set forth, and compliance therewith is specifically made a condition hereto, with the following additions: (a) Parking on the South Lot, the southernmost 13. 5 acres of the property, shall be prohibited in the area designated on said plan as subject to flooding by a five-year 30-minute storm. (b) The retention pond, spillway on the west side of the pond, as referenced in the said plan, shall be rip- rapped to prevent erosion. (c) Improvements to the referenced retention pond are permitted to provide increased capacity of water retention, to reduce the flooding area and thereby to increase the area usable for parking.
