CONDITIONAL USE PERMIT NO. 376 Page 2 <br /> EXHIBIT "B" <br /> 1. All uses on the subject property shall be held in accordance <br /> with all provisions of the deed restrictions of record at the <br /> Dane County Register of Deeds office, recorded at Records, <br /> Volume 6039 , Page 1, as document No. 1849050 which document <br /> is incorporated herein in its entirety as if fully set forth, <br /> except as otherwise provided herein. <br /> 2. As used herein and as used in the referenced deed <br /> restrictions, the following definitions shall apply: <br /> Facilities The entire premises including all <br /> land and accessory structures. <br /> Facilities Closed Vacated by the public. <br /> Public All natural persons except track <br /> personnel as defined herein. <br /> Racing Season April 1st thru Oct. 31st. <br /> Secured Gates Closed to public access but not <br /> necessarily locked. <br /> Track Personnel All persons involved in organizing <br /> or producing the race, including pit <br /> crews and other race associated <br /> personnel, other than spectators. <br /> 3. Racing events held outside the racing season as defined above <br /> shall conform with all other conditions herein stated and in <br /> addition shall require prior approval of the Committee, with <br /> notice to the Town Board of the Town of Rutland. Approval <br /> will not be unreasonably withheld. <br /> 4. Warzyn Plan #MC-204188-2, dated September 26, 1984, is <br /> incorporated herein in its entirety as if fully set forth, <br /> and compliance therewith is specifically made a condition <br /> hereto, with the following additions: <br /> (a) Parking on the South Lot, the southernmost 13. 5 <br /> acres of the property, shall be prohibited in the area <br /> designated on said plan as subject to flooding by a <br /> five-year 30-minute storm. <br /> (b) The retention pond, spillway on the west side of <br /> the pond, as referenced in the said plan, shall be rip- <br /> rapped to prevent erosion. <br /> (c) Improvements to the referenced retention pond are <br /> permitted to provide increased capacity of water <br /> retention, to reduce the flooding area and thereby to <br /> increase the area usable for parking. <br />
