%din Of *dint <br /> DANE COUNTY, WISCONSIN <br /> August 5, 1987 <br /> Mr. William Fleck <br /> fir,21 <br /> Dane County Zoning Department r1 <br /> City-County Building vG <br /> Madison, Wisconsin 53709 <br /> RE: Petition No. 3216/C.U.P. #376 <br /> Dear Mr. Fleck; <br /> Petition No. 3216/ Conditional Use Permit #376 by William Abbott, <br /> agent for Impact Speedway to amend the Deed Restriction in the C-2 Commercial <br /> District and also to amend the conditional use permit on the same parcel <br /> was on the agenda for the Town of Rutland meetings held on August 3 and <br /> August 4. <br /> In this matter, Mr. Abbott requested the conditional use permit <br /> be amended to include the following language: <br /> "The conditional use permit. . .shall be amended such that racing <br /> and motor sports of all types shall be permitted uses thereunder." <br /> The Rutland Town Board disapproves of the requested amended language <br /> because it is simply too broad. Language this broad could be interpreted <br /> to include everything except motorless motion. The requested language <br /> in this form is simply too general for the Board to consider giving approval <br /> to it. <br /> The Town Board, further, would like to address the erroneous conclu- <br /> sions of Mr. Abbott in his letter to you dated July 2, 1987. The Town <br /> Board does not consider the requested change is a "minor" change; further- <br /> more, the specific amended language as stated in the letter was never presented <br /> or discussed with the Town Board. The Town Board strongly feels that the <br /> other town property owners have the right to be considered and should have <br /> the opportunity to present their views and feelings on this matter. <br /> It should also be noted that the new owners of the racetrack are <br /> using the same attorney who drafted the original Deed Restrictions and <br /> were certainly made aware of its provisions, namely that the permitted <br /> use was limited to auto racing only. <br /> 7 <br />
