• <br /> • <br /> DANE COUNTY ORDINANCE AMENDMENT NO: 9802 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Oregon. <br /> • <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps <br /> of the Town of Oregon be amended to include in the A-2(4) Agricultural district(s) following <br /> described land: <br /> PETITION NUMBER: 9802 <br /> Part of Section 09, Town of Oregon described as follows: <br /> A-1EX TO A-2(4) <br /> Part of the Northeast 1/4 of the Northwest '/a, Section 9, Township 05 North, Range 09 East, Town <br /> of Oregon, Dane County, Wisconsin, described as follows: <br /> Commencing at the North 1/4 Corner of said Section 9; thence S89°31'52"W along the North line <br /> of the Northwest 1/4, 510.70 feet to the Northwest Corner of lands recorded in Volume 422, Page <br /> 567, and the point of beginning; thence S00°18'54"W along the West Line of said lands recorded <br /> in Volume 422, Page 567, 511.81 feet; thence S00°00'53"W along the West Line of CSM No. <br /> 2183, 522.09 feet; thence S89°38'06"W. 296.01 feet; thence N00°00'53"W, 600.36 feet; thence <br /> N89°31'52"E, 196.46 feet; thence N00°18'54"E, 433.00 feet to the North Line of said Northeast <br /> 1/4 of the Northwest 1/4 and the centerline of C.T.H. "D"; thence N89°31'52"E along said North <br /> Line, 100.00 feet to the point of beginning. Containing 5.076 acres. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b) of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following conditions. <br /> 1. The final site plan shall include the following: The detention basin shall be moved 100 feet to the <br /> south; The detention basin shall have a depth of 3 feet; two rows of trees shall be located along <br /> the east property line for screening; the driveway turn-around shall be moved 9 feet to the west; <br /> the driveway shall be moved 13 feet to the west;the incoming powerline shall be moved 13 feet <br /> to the west; <br /> 2. The Certified Survey Map shall show the following: 60-foot road right-of-way dedication along <br /> County Highway"D"; a 50 feet x 420 feet"no building zone" shall be designated along the east <br /> property line. <br /> 3. Landscaping and screening shall be provided by Alliant Energy for adjacent property owners. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective if,within 90 days of its adoption by Dane County,the owner or owners of <br /> the land record the following restriction(s)on said land: <br /> 1. A-2(4)zoned parcel(outlot 1)shall be deed restricted prohibiting residential housing. <br /> Said restriction(s)shall run in favor of Dane County and the pertinent Town Board(s)as well as the owners of <br /> land within 300 feet of the site. Failure to record the restriction(s)will cause the rezone to be null and void. <br /> A copy of the recorded document shall be submitted to Dane County Zoning. <br /> The Dane County Board of Supervisors does ordain that this amendment, based upon Their findings, to be consistent <br /> with the provisions Of Wisconsin State Statute 91.77(1)(a),(b).((c). <br />
