A .1, • - <br /> September 8 ,1984 <br /> Re: Petition No. 3311 <br /> Wilbur Dushack one of partners who is selling the property <br /> stated this a repeat of Petition No. 3274 which was presented <br /> and approved at the July 5 ,1984 Town Board Meeting. It is <br /> presented again because there was a "no show" on their part <br /> at the July 10,1984 County Committee Hearing, thusthe Petition <br /> was denied. <br /> Mr. Dushack stated the area proposed for rezoning ( 23.4 acres) <br /> should be amended to be 19. 5 acres. <br /> On file is a carbon copy of an "Amendment to Contract of Sale" <br /> which included the following amendments : <br /> Buyer is aware total number of acres to be sold is 19.5 acres. <br /> Buyer is aware that a rod of buyers frontage to be dedicated <br /> for Alvin Road. <br /> Buyer is aware that he will have to pay one—third of the cost <br /> for paving that part of Alvin Road that fronts his property. <br /> The propestive buyers and the sellers signed this "Amendment" <br /> which should be attached to the offer to purchase. <br /> The expected highway costs in improving the present Alvin Road <br /> was discussed. The Chairman stated the Town will want a signed <br /> agreement by all parties involved in sharing the costs of the <br /> road improvement of Alvin Road before approval of the certified <br /> survey of this petitioned area. <br /> The Town Board having considered the Petition acted when Lloyd <br /> Yelk moved to approve the change sought by Petition # 3311, <br /> seconded by J.Michael Blaska and motion carried. <br />
