County of Dane
DATE: July 9, 1985
TO: Agriculture, Environment & Land
Records Committee
FROM: William Fleck,
Zoning Administrator
SUBJECT: Reider -Verona. Petitions #3336 & #3387.
Mrs. Reider applied for rezone on October 1, 1984. She did not have a legal
description for the proposed rezone but stated she would have Thom Grenlie
provide us with one as he was doing the survey for her. One of Thom Grenlie's
men dropped off the "preliminary" survey on the 2nd or 3rd of October, (see
attached copy) . All indications were that this was to be a C.S.M. which is
not unusual even though not required.
The notice was sent out with the C.S.M. delayed effective date included and
was reviewed by all concerned eg: Regional Planning Commission, Plat/CSM
Review, Committee etc. The C.S.M. issue arose after the zoning petition was
approved by the County Board and we had sent notice to Mrs. Reider and Thom
Grenlie that the C.S.M. had to be recorded by a certain date. Dan Bierncott
Surveyor came into our office wondering why a C.S.M. was required. We investi-
gated and found out that a C.S.M. was not required, but by the fact that the
delayed effective deadline was on the petition approved by the County Board,
there was no way the zoning could be effective without fulfilling the require-
ment of recording a C.S.M.
I was going on vacation and therefore referred the matter to Steven H. Reynolds.
He called Mrs. Reider, apologized and explained the situation. He also called
Judy Rendall and H. Dahlk to explain. It was agreed that Harland would re-
submit the petition to correct the situation. Mrs. Reider was informed.
Zoning Staff at no time insisted or demanded that a C.S.M. be made. Steven
H. Reynolds because of the submittal of a preliminary survey map presumed
one was going to be made. His contact with Mrs. Reider was to explain and
apologize for the inadvertant error and correlate the process to correct it.
Mrs. Reider was understanding and was not overly disturbed.
Enclosure:
