DANE COUNTY ORDINANCE AMENDMENT NO: 9690 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Medina. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps <br /> of the Town of Medina be amended to include in the RH-2 Rural Homes district(s)following <br /> described land: <br /> PETITION NUMBER: 9690 <br /> A parcel of land located in the Northeast 1/4 of the Northeast 1/4 of Section 4,T8N,R12E,Town of <br /> Medina,Dane County Wisconsin being more particularly described as follows: Commencing at <br /> Northeast corner of said Section 4;thence along the East line of the said Northeast 1/4, <br /> S01°23'00"W, 33.05 feet to the southerly right of way line of Clarkson Road and the point of <br /> beginning;thence continuing along said East line S01°23'00"W,308.00 feet,thence S88°07'22"W, <br /> 399.26 feet to the East line of Lot 1, Certified Survey Map No. 11739;thence along said East line <br /> NO2°14'35"W(Recorded as N00°45'36"E),307.50 feet to the said southerly right of way line of <br /> Clarkson Road;thence along said southerly right of way line N88°07'22"E,418.74 feet to the point <br /> of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane County <br /> Code of Ordinances. The rezoned area shall be subject to the following conditions. <br /> 1. Amend the petition request fi-om A-2(4)to RH-2. <br /> 2. Approval is conditioned upon the applicant recording the town of Medina's <br /> Notification of Covenants and Restrictions restricting further development on the <br /> subject property with the Register of Deeds within 90 days of rezone approval by <br /> Dane County. A copy of the recorded document must be provided to Dane County <br /> Zoning within 90 days of rezone approval. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective if within 90 days of its adoption by Dane County the owner or <br /> owners of the land record the following restriction(s)on said land: <br /> 1. Deed restrict the RH-2 parcel limiting the number of livestock to no more than a total of <br /> 10 animals. <br /> Said restriction(s)shall run in favor of Dane County and the pertinent Town Board(s)as well as the <br /> owners of land within 300 feet of the site. Failure to record the restriction(s)will cause the <br /> rezone to be null and void. A copy of the recorded document shall be submitted to Dane <br /> County Zoning. <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon Their findings,to be consistent <br /> . with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
