The proposed amendment would add a <br /> new conditional use in C2 commercial districts--"overnight <br /> parking in parking lots located on motor vehicle racetrack <br /> facilities. " The hearing is before the County Zoning Committee <br /> on April 9 , 1985 at 7 :30 p.m. As we discussed on the phone <br /> yesterday, I will attend that hearing as attorney for the Town of <br /> Rutland. <br /> A. Effect of the Proposed Amendment. • <br /> The proposed amendment itself would not immediately <br /> affect the 'CRC Speedway situation. The speedway property is now <br /> zoned C2 , but its use is limited by the conditional use permit <br /> and the deed restrictions to automobile racing only. Any <br /> accessory uses are spelled out in the deed restrictions. If the <br /> amendment passes, CRC Speedway, in order to allow overnight <br /> parking, would still have to seek an amendment to its conditional <br /> use permit. Obviously, the speedway is seeking the ordinance <br /> amendment so that it may then request a change in its conditional <br /> use permit to allow overnight parking. <br /> There are a couple of issues to highlight regarding <br /> this proposed amendment. First of all, what is meant by <br /> "overnight parking in parking lots?" The Town has never had any <br /> problems with the mere presence of vehicles in the speedway <br /> parking lot overnight; the problems have been caused by people <br /> who have remained on the premises overnight along with the <br /> vehicles. <br />
