zoning limits the use to major auto repair , excluding all <br /> other commercial uses under C-1 and C-2 zoning and applies <br /> only to the property identified in paragraph #1 hereof . <br /> In consideration of the above, the parties agree as follows : <br /> 1. Property owner will petition Dane County to rezone the <br /> premises at 6974 Old Sauk Road as described above in paragraph #1 <br /> for commercial use restricted to major auto repair and excluding <br /> all other commercial uses permitted under C-1 and C-2. <br /> 2. On or before June 15 , 1985 , property owner will file a <br /> petition at property owner 's expense requesting that the above owners <br /> premises be rezoned A-1 or R-1 , and shall follow rezoning process <br /> through to successful conclusion. <br /> 3. Property owner will rent the property only to Jim's Body <br /> and Auto Repair , James Millar , proprietor , while this agreement <br /> is in effect. <br /> 4. If Jim's Body and Auto Repair vacates the premises or if <br /> James Millar ceases as proprietor before June 15 , 1985 , property <br /> owner will file the petition within 30 days from that date. <br /> 5. If the sale of this property is anticipated before the <br /> property owner has petitioned for rezoning, property owner will <br /> file the petition and rezone before completing a sale of the <br /> property. <br /> 6 . Property owner will file with the Town of Middleton a <br /> $5,000 performance bond to insure the property is converted back <br /> to A-1 or R-1 zoning. This bond shall continue until the zoning <br /> has been changed back to A-1 or R-1 zoning and shall be in <br /> proper form acceptable to the Town of Middleton . <br /> Page 2 out of 3 <br /> .: # <br />
