WHEREAS, Jack McManus is/are <br /> the owner or owners of the following described land in the Town of <br /> Dunn , Dane County, Wisconsin, to-wit: <br /> (Zoning Description Map and Certificate attached hereto) <br /> Part of the SW 1/4, NW 1/4, and Part of the SE 1/4, NW <br /> 1/4, of Section 33, T6N, R10E, Town of Dunn, Dane County, RECEIVED <br /> Wisconsin, being more particularly described as follows: <br /> Commencing at the Southwest corner of said Section 33; , JUL 1 1965 <br /> thence N 89°48'45" E, 1,785.42 Feet; thence N 00°09'39" 14, DANE COUNTY <br /> 3,324.82 Feet; thence S 87°50'46" W, 419.85 Feet to the point ZONING . « <br /> of beginning; thence N 88°32'52" W, 129.08 Feet; thence N <br /> 00°33'23" W, 108.76 Feet; thence S 86°05'26" E, 126.60 Feet; <br /> thence S 02°05'46" E, 103.46 Feet to the point of beginning. <br /> Said parcel contains 13,528 Square Feet or 0.3106 Acres. <br /> 2. WHEREAS, the said owner desires to place certain restrictions thereon, to <br /> bind the owner and those who may acquire title hereafter; <br /> 3. NOW, THEREFORE, in consideration of the mutal benefits passing to and from the <br /> owner and those who may hereafter purchase said land and the parties named as <br /> beneficiaries of these restrictions, the following restrictions are hereby im- <br /> posed: <br /> Said property and any building thereupon to be used only as a law office <br /> with a maximum of 3 full time lawyer equivalents and necessary support staff. <br /> If any Indian artifacts are found during construction of said building <br /> the Wisconsin State Historical Society will be notified and allowed to <br /> preserve same. <br /> The zoning of the described land shall revert to Agriculture zoning upon the <br /> death of Jack McManus or upon him ceasing to practice law at the described <br /> location, whichever occurs first. If Jack McManus is still practicing law <br /> at the described location 10 years after the recording of this instrument <br /> the Town of Dunn may review the rezoning of B-1 Local Business. It may <br /> disapprove the continuation of that rezoning, but only if there is non- <br /> compliance with these restrictions or with the land use policies in effect <br /> on July'15, 1985. <br /> That the building be served by a separate septic system and well. <br /> That the gravel road known as McManus Road in said Section 33, T6N, 810E <br /> in the Town of Dunn, Dane County, Wisconsin, shall revert to said Jack McMaus <br /> and be said Jack McManus' responsibility in all respects and that proper <br /> documents shall be furnished by proper Governmental bodies for said purposes. <br /> These restrictions shall constitute covenants running with the land and shall <br /> be binding upon all parties now owning any part of said land, their successors, <br /> heirs and assigns, and all parties holding under them unless, pursuant to para- <br /> graphs 5 or 6 of this instrument, said restrictions are amended or terminated. <br /> - 1 - <br />
