MATTER CONCERNING CONSOLIDATED PAVING COMPANY, INC. <br /> 2 OPPIONS -- <br /> I. CONDITIONAL USE PERMIT ONLY TO ALLOW CONSOLIDATED TO HAUL GRAVEL OUT <br /> II. CONDITIONAL USE PERMIT <br /> Conditions of Conditional Use Permit --- <br /> Allow them to remove gravel only until an Environmental Impact Study <br /> is completed. If Environmental Impact Study shows no problem, the <br /> following conditions must be met: <br /> 1. Consolidated to post a bond to cover potential damage to <br /> surrounding wells and ground water in the amount of two million <br /> dollars. <br /> 2. Herman Erb to insure the premium of the bond if Consolidated goes <br /> out of business or fails to cover the bond. This bond will <br /> cover a 5 year residual period after the hot mix plant vacates <br /> or dismantles. <br /> 3 . No gravel to be hauled into the plant from outside the 35 acre <br /> parcel (including adjacent property) . <br /> reA <br /> No additional rezoning of Herman Erb farm will be allowed while <br /> the hot mix plant is on that property. <br /> �. No excavation below water level. <br /> 6. Before approving site, Consolidated must provide a blue print of <br /> site showing where the roads, plant and berm holding ponds will <br /> be located. This must be approved by local residents. <br /> r-. <br /> 1 A road must be built directly to the plant from Hwy. T by <br /> Consolidated and be maintained by them. No Town of Sun Prairie <br /> taxes shall be used for maintaining the road. <br /> 8. Holding ponds will be built of cement and have a 25 year storm <br /> capacity. <br /> 9. Since Consolidated will be pumping a considerable amount of water <br /> each month, if the water level gets to a dangerous level with <br /> local wells failing, Consolidated will have to stop pumping water. <br /> 10. Need clarification of how holding ponds will be cleaned and where <br /> the residue will go. <br /> 0 No fueling or storage of equipment will be allowed on the site. <br /> X12 Hours of operation shall be limited to 7:30 a.m. to 5:30 p.m. , <br /> Monday - Saturday. <br /> 13 . When hot mix plant ceases to operate, it will be the responsibilitj <br /> of Herman Erb to undertake a reclamation program to put the land <br /> back to its natural state or to restore it to productive <br /> agricultural use. <br /> 14. There shall be four ground water monitoring wells located at the <br /> perimeter of the plant. <br /> There shall be periodic inspection of the site to verify <br /> �'4 operating conditions. <br />
