•
P Z-3S I
Schutte, Kristine PE D► £, P
From: Schutte, Kristine
Sent: Tuesday, July 29, 2008 6:38 PM
To: Dean Harding (E-mail)
Cc: Lane, Roger; Tuggle, Jason
Subject: Murphy Boathouse Zoning Permit
Hi Dean --
I reviewed the site plans, floor plans and elevations for the proposed reconstruction of the Murphy boathouse. I also had
Roger look them over. He approved the restoration of the boathouse to its exact size and height and in its exact location
as per State Statute 59.692(1)(s). I've prepared the Zoning Permit for you. The fee will be$126.00.
The plans you submitted were actually slightly smaller(a matter of a few inches in any dimension, at most) than the
existing boathouse as shown both on the July 3, 2008 Birrenkott survey and on the plans submitted in 1998 for the addition
of the side and rear decks, under the Murphys' Variance Appeal 2970 and Zoning Permit 1998-2101. This meets the
requirement for exact replication of size.
Two Conditions of the Zoning Permit required by Zoning Administrator Roger Lane are:
1) The owners shall sign a notarized document for the file (copy attached) stating that the use of both levels of the
proposed boathouse is limited to boat and Jetski storage and boat and Jetski accessory storage plus storage of any other
"boats, canoes and other water craft and their accessories"as per Dane County Code of Ordinance (DCCO) Section 10.01
(6a), and that there will be no"human habitation" (i.e., any human use other than that associated with the storage of boats
and their accessories) of the boathouse as per S. 11.015(2) DCCO. The owners must agree to yearly inspection of the
boathouse by Zoning Division staff to verify the continuing permitted use. The document will remain in the Zoning Permit
file.
2) Your elevation drawings did not include any dimensions. The proposed restored boathouse peak elevation must not
exceed 863.98 MSL (Mean Sea Level) as shown on the 07/03/2008 survey. This is slightly taller than the 863.66 MSL
height shown on the plans submitted for the 1998 variance and permit, which allowed the Murphys to build the two decks
adjoining the boathouse and the access stairs on the east side. (The decks are now existing non-conforming structures,
as they are no longer permitted under the shoreland ordinance. The stairs and boathouse continue to be permitted uses.)
The as-built height of the boathouse must be verified by survey.
In addition:
• Please note that the location of the rebuilt boathouse must remain 4.0 feet from the edge of the existing concrete
seawall.
• Question--Are you rebuilding the 4'x12.2' entry deck on the east side of the upper level? I'm including the small deck
in the permit unless you tell me otherwise. The stairs will remain, won't they? I'm not including them.
• Note that the Access Path shown on the Shoreland Erosion Control Permit 2008-0073 site plan must be a temporary
construction access only, to be restored to lawn or other landscaping as shown on SE permit plans, after construction
is complete. The SE permit expires on the 08/15/2008 expiration date, unless amended prior to that date. Contact
Jason Tuggle at L&WR 224-3730.
Dean, I need:
A. The cost of construction for the Zoning Permit.
B. The signed, notarized statement from the Murphys.
C. The check for$126.00.
I'll enter all the information from the Murphy's Variance Appeal 3522 into the computer for the"Pending" Zoning Permit.
Please let me know when you'll provide all of the above.
Thanks, Kris
1
