# . /7" 'S <br /> AGREEMENT <br /> This Agreement is made this 00 day of , 1987 , <br /> by and between the Town of Vienna (hereinafter Town) , Roger I. <br /> Kittleson and Liela J. Kittleson (hereinafter Owners) , and <br /> Madison Sand & Gravel Co. (hereinafter Madison Sand) . <br /> WHEREAS , Owners and Madison Sand have entered into a mineral <br /> lease whereby Madison Sand has the right to extract mineral <br /> aggregates from Owners ' real estate located in the Town of <br /> Vienna, Dane County, Wisconsin, more particularly described as <br /> follows: <br /> West one half (1/2) of the Southwest one quarter (1/4) <br /> of the Northwest one quarter (1/4) of Section 11 , <br /> Town 9 North, Range 9 East, Dane County, Wisconsin. <br /> WHEREAS, prior to commencing the extraction operation Owners <br /> and Madison Sand must secure a conditional use permit for the <br /> operation from the County; and, <br /> WHEREAS, the Town wishes to place certain conditions and <br /> restrictions on the extraction operation and on the conditional <br /> use permit. <br /> NOW, THEREFORE, the parties hereto agree to the following: <br /> 1 . The extraction operation and the reclamation thereof <br /> shall be completed within twenty (20) years from the date of the <br /> conditional use permit. <br /> 2 . The conditional use permit is hereby granted for an <br /> initial five (5) year period from the date of the conditional use <br /> permit. After' the initial five (5) year period, and every five <br /> (5) years thereafter, the operation will be reviewed by the <br /> parties in order to determine whether amendments to this <br /> Agreement should be made.
