CSM 9924.Sec 9 T6N.R7E Town <br /> of Springdale, Dane County, Wisconsin. <br /> WHEREAS, Timothy S. Hilby and Debra L. Hilby the owners of the above referenced Lot 2, <br /> CSM 9924; <br /> WHEREAS, Ronald V. Beaton the owner of the above referenced Lot 3,CSM 9924; <br /> WHEREAS, it is necessary to establish the terms and conditions of a Joint Driveway Agreement <br /> for that portion of the driveway which serves both Lot 2 and Lot 3; <br /> NOW,THEREFORE, I,Timothy S. Hilby and Debra L. Hilby being the owners of Lot 2, CSM <br /> 9924, and Ronald V. Beaton being the owner of Lot 3,CSM 9924, do hereby declare as follows; <br /> JOINT DRIVEWAY <br /> A driveway has already been constructed for the above-described Lot 2 and Lot 3,CSM 9924. <br /> The following terms and conditions shall apply to the driveway. <br /> One: The Owners of Lot 2 shall bear all future maintenance,repair, and snow removal costs for <br /> the driveway entrance that is North of the existing property line between Lot 2 and Lot 3; the Owner of <br /> Lot 3 shall bear all future maintenance,repair, and snow removal costs for the entrance that is South of <br /> the property line between Lot 2 and Lot 3. <br /> Two: If the Owner of Lot 3 causes any damage to the driveway entrance used by Lot 1, Lot 2, <br /> and Lot 3, such damage shall be at the sole expense and repair of the Owner of Lot 3. <br /> Three: No Party, nor any party claiming an interest in said driveway through any party, may <br /> utilize the driveway in any way that would interfere with the other party's free use of the driveway, unless <br /> required temporally for the further improvement of the driveway. <br /> Four: The Town of Springdale shall have no responsibility and/or involvement in any dispute <br /> between the parties. <br /> Five: The above described Agreement shall insure to the benefit of and shall be binding upon the <br /> heirs, successors, and assigns of the current owners of Lot 2 and 3. The provisions hereof shall run with <br /> the land and shall have perpetual effect unless modified or amended by a mutual agreement, in writing, <br /> signed by parties having an interest in the above referenced lots. <br />
