WHEREAS, said owner(s) desires to place certain restrictions on the above-said real estate, to bind <br /> the owner(s) and those who may acquire title hereafter. <br /> WHEREAS, the restrictions provided herein shall be enforceable at law or equity against any party <br /> who has or acquires any interest in the land subject to these restrictions by the following who are <br /> named as grantees and beneficiaries with enforcement rights: <br /> 1. The County Government of Dane County, Wisconsin provided that the lands are under <br /> the jurisdiction of the County zoning ordinance at the time the enforcement action is <br /> commenced, and; <br /> 2. The Town Government of the Town of Springdale, Dane County, provided that the lands <br /> are within the jurisdiction of said Towns at the time the enforcement action is <br /> commenced, and; <br /> 3. The owner(s) of record of any lands that are located within 300 feet of the subject <br /> property. <br /> THEREFORE, the following restrictions are hereby imposed: (Use reverse side or attachment if more space is <br /> needed.) • <br /> 1. The land use of the property shall be limited to a landscaping/snowplowing business,storage of a maximum of 12 <br /> pieces of construction equipment associated with the business,and maintenance and repair of only the <br /> construction equipment used in the landscaping/snowplowing business. . <br /> 2. All equipment shall be stored indoors as soon as the new building is completed. <br /> 3. A landscaping plan shall be submitted for approval to the Springdale Town Board with a$15,000 bond prior of <br /> the Town Board's confirmation of the rezoning. The landscaping as depicted on the approved plan shall be <br /> installed by October 2008. The approved plan shall include a fence along the north property line,220' long and <br /> 6'-8"high,visual screening from the roadway with trees and berms,the driveway location,and location of the <br /> proposed building. <br /> 4. The fencing along the north property line shall be maintained to provide for an attractive appearance. <br /> 5. After September 2008,the overhead doors on the north side of the building shall be prohibited from ingress/egress <br /> to the building. A new entrance shall be constructed on the west or south walls. <br /> 6. A sign on the property shall be limited to a 2'x3'unlit sign. <br /> 7. Outdoor lighting,except required security lighting,shall be operational only during hours of business operation. <br /> All lighting shall be shielded to prevent glare into the night sky or direct-beam illumination to neighboring <br /> properties. All new lighting fixtures shall use full cut-off fixtures,which prevent all upward transmission of light. <br /> Lighting on the north side of the building is prohibited. Security lighting shall be motion sensor lighting only. <br /> 8. The hours of operation are 7 am to 8 pm,Monday through Saturday,except for hours of operation from 7 am to <br /> 10 pm from May 1 through September 15,and"emergency repairs only"permitted on Sunday or after designated <br /> hours. <br /> • 9. Architectural review and approval by the Town of Springdale Plan Commission shall be required to insure that <br /> the exterior appearance,design,and character of the proposed improvements,including parking facilities and <br /> signs,will enhance the rural quality of the life throughout the Town. <br /> 10. On-site buming of materials brought from off-site shall be prohibited. <br />
