Chandler <br /> Section 27, Town of Albion. <br /> Dear Mr. Marsden: <br /> This letter will confirm our phone conversation on November 17, 1987 <br /> regarding the Town Board's desire to have the property revert back to <br /> A-1 Ex. Zoning if the business is sold. I am sorry but, an automatic <br /> revision of zoning change may not be incorporated into a Zoning Petition. <br /> Zoning changes are regulated by State Statute with a defined process <br /> that must be followed. The Town Board, Zoning Committee, County Board <br /> and County Executive all have a "say" in the approval or denial of a <br /> zoning change and a public hearing must be held by the County. This <br /> process would be nullified by an automatic reversion and is therefore <br /> not allowed. <br /> Several towns have accomplished a close proximation to reversion of zoning <br /> by utilization of a separate agreement between the applicant and the <br /> town. The agreement specifies that an application to rezone back to <br /> A-1 Ex. (or some other satisfactory zoning) if the use is terminated <br /> or the property sold. This provides for the statutory process required <br /> for rezone. <br /> Other things such as a performance bond may also be included. I have <br /> enclosed a copy of an agreement drawn up by the Town of Middleton, you <br /> can review it and adapt it to your desires. <br /> Petition #4117 is scheduled for public hearing on December 10th and the <br /> Zoning Committee Work Meeting is December 22nd.
