Agriculture to R-4 Residential . <br /> multi-family in order to provide zoning compliance for an already constructed 3rd floor <br /> apartment addition. You approved the rezone subject to conditions and deed restriction <br /> limiting the use. <br /> I had a problem trying to include the requirement that the construction be brought <br /> up-to-code, as a conditional zoning, it just doesn't fit the intent of that provision of <br /> the Zoning Ordinance as it is currently written. I included the up-to-code requirement <br /> as a deed restriction to facilitate Committee action but, that is not really appropriate <br /> either. <br /> I checked with the State for clarification of what might be required to bring the <br /> construction up-to-code and it was evident that there were several critical areas of <br /> compliance with multi-family plumbing, hearing, electrical etc. ,. The State advised <br /> that compliance might be cost prohibitive. Septic compliance is an additional factor. <br /> Therefore, I suggest that the petition be re-referred to Committee and that you hold <br /> action pending State approval of the preliminary building plans for the multi-family <br /> residence. The preliminary plans can be submitted at nominal cost and will provide the <br /> applicant with the necessary information on cost to decide if he will proceed with <br /> compliance. If he does not decide to proceed the zoning petition could be denied. <br /> CC: Gene Rankin, Director <br />
