DUPLICATE <br /> ORIGNL <br /> COVENANT AGREEMENT / : _�,, 7 <br /> Re The Following Lands: <br /> Part of the North 1/2 of the Northeast 1/4 of Section 14, Township 7 North, <br /> Range 11 East, (Town of Cottage Grove) more fully described as follows: <br /> Beginning at the North 1/4 corner of said Section 14; thence South 0° 25' <br /> 27" West, 903.03 feet; thence South 88° 0' 06" East, 241.09 feet along the <br /> centerline of West Ridge Road; thence North 0° 25' 27" East, 910.53 feet; <br /> thence North 89° 46' 58" West, 241.0 feet along the North line of said <br /> Section 14 to the point of beginning of this description. <br /> [said parcel also being currently known as Tax Parcel 09-14-332-1] <br /> 1. This is an Agreement between Richard H. and Joy F. Wood, husband and wife, <br /> ("Applicant"), and the Town of Cottage Grove, in the County of Dane, State of Wisconsin <br /> ("Town"). <br /> 2. Applicant has contracted to purchase the above described parcel and has drily <br /> applied for rezoning to the LC-1 District of that portion of the parcel described as <br /> follows: <br /> Beginning at the North corner of Section 14, Township 7 North, Range 11 <br /> East, Town of Cottage Grove, Dane County, Wisconsin; thence S0°25'27"W, <br /> 870.00 feet to the point of beginning, thence S88°0'6"E, 100.04 feet, thence <br /> N0°25'27"E, 201.38 feet, thence N89°34'33"W, 100.00 feet, thence S0°25'27"W, <br /> 198.63 feet to the point of beginning. <br /> 3. Applicant and its heirs, successors and assigns will limit the use of the LC-1 <br /> District portion of the referenced lands to the operations of Applicant's business, <br /> consisting generally of communications contracting services, to the extent that such <br /> operations are permitted in the LC-1 District under applicable zoning ordinances. <br /> 4. Upon the cessation of such business operations or upon their suspension for a <br /> continuous period of one year, Applicant shall duly apply for rezoning of the LC-1 <br /> portion of the referenced lands to the Zoning District then designated for the contiguous <br /> portions of' the referenced lands, and Applicant shall then pursue and prosecute that <br /> rezoning application in good faith. <br /> 5. If Applicant fails to file the application for rezoning required under Paragraph 4. <br /> above within three months of the date required by this Agreement, then the Town is <br /> and shall be designated Applicant's agent for the purpose of filing the application for <br /> rezoning, and the Town is authorized as such agent to prepare, file and prosecute such <br /> application. Applicant hereby consents to rezoning pursuant to such application filed <br /> by the Town as Applicant's agent and will indemnify and hold harmless the Town for <br /> actual expenses incurred as Applicant's agent in filing such application. <br /> 6. This Agreement shall terminate as follows: <br /> a. By the mutual agreement of the parties or their respective successors, assigns <br /> or heirs; or <br /> b. By unilateral action and declaration of the Town. <br />
