CITY OF SUN PRAIRIE <br /> OFFICE OF THE MAYOR <br /> 124 COLUMBUS STREET <br /> SUN PRAIRIE, WISCONSIN 53590-2299 <br /> (608) 837-2511 <br /> June 22, 1988 <br /> Dane County Agricultural, Environment and Land Records Committee <br /> Room 116, City-County Building <br /> Madison, Wisconsin 53709 <br /> RE: Sun Prairie Memory Gardens Property <br /> Petition Numbers 669 and 4242, Requested Rezoning and CUP <br /> Dear Committee Members <br /> The City of Sun Prairie has had an opportunity to review the requested <br /> rezonings and application for conditional use permits as proposed by the <br /> joint petitioners, Anchor Savings and Loan and Kenneth O'Malley. <br /> First, the City is distressed to learn that the carefully drafted State <br /> Statutes regarding subdivision and the ability of municipalities to make <br /> comment on proposed subdivisions within their extraterritorial area can <br /> be effectively circumvented by a sheriff's auction. Although the County <br /> Sheriff's Office is a highly valued agency, it is hardly in the position <br /> to make consistently rational decisions regarding land division. The <br /> City of Sun Prairie would have vigorously opposed the division of the <br /> O'Malley property had our opinion been sought. <br /> Second, recognizing this loophole, City of Sun Prairie staff has worked <br /> with the petitioners to attempt to reach a consensus approach to the <br /> petition which accommodates the interests of both petitioners, the Town, <br /> and the City. The City of Sun Prairie's recently adopted Comprehensive <br /> Plan indicates that the petitioner's property located south of the <br /> cemetery is best suited for nonresidential development. Land uses <br /> currently existing in the immediate vicinity of the subject property, <br /> including the Wisconsin Cheeseman candy factory, an auto storage yard, <br /> and the City of Sun Prairie's sanitary sewage treatment plant clearly <br /> indicate the predominant land use trend in this area. <br /> The requested rezoning of the 5.89 acre parcel from the A-1 Exclusive <br /> designation to the RH-2 designation would create the possibility for <br /> additional residential development in this area. To prevent this, the <br /> City of Sun Prairie has suggested to the petitioners that the County's <br /> A-2 designation be applied instead. It is our understanding that by <br /> using this approach, a conditional use permit and/or rezoning would be <br /> required before residential, commercial or industrial development could <br /> occur on the property. At such time development of the property is <br /> desired, the City will be requesting that the County deny such a request <br /> and suggest that annexation into the City be considered.
