The Wisconsin Supreme Court held: <br />"The October 19, 1949, ordinance contained no savings <br />clause exempting existing nonconforming uses. If the <br />ordinance in the instant case were to be construed as <br />being retrospective in operation, it would be <br />unconstitutional and invalid with respect to plaintiff's <br />vested interest in his trailer and the right to continue <br />to use the same on his own land for dwelling house <br />purposes." Des Jardin, supra, 53 N.W.2d 784 at 786 <br />(1952) . <br />In another case a developer purchased a parcel of land and <br />commenced the installation of valuable improvements to define lots, <br />sites or pads for a mobile home park on property where the use was <br />permitted under county zoning. While the work was being done, the <br />county zoning ordinance was changed to prohibit the use. For the <br />purpose of discovering the "use" protected by the nonconforming use <br />statute, the Wisconsin Supreme Court held the focus was on the park <br />as a whole and the owner's investment in the improvements necessary <br />to define lots, sites or pads. <br />"At the time of its effective date the plaintiffs had <br />already purchased the property and improved it for use as <br />a trailer camp. These improvements consisted of drilling <br />a well, installing sewers and electricity, constructing <br />a utility building with laundry facilities, construction <br />of a 30 foot wide gravel road and other matters necessary <br />to the operation of a trailer camp or park.
