discourage the park owner from replacing older mobile homes with <br />newer, more safe and more attractive mobile homes? <br />OVERRIDING PURPOSE AND POLICY OF ZONING <br />SHOULD BE TO ENCOURAGE PARK IMPROVEMENT <br />The overriding policy purpose or goal of zoning and other land <br />use regulations is to improve the quality of property and enjoyment <br />of life. The zoning ordinance should not give a mobile home park <br />owner an economic incentive to keep old mobile homes located on <br />their sites beyond their useful life. This causes deterioration of <br />the mobile home park community. <br />If the protection of nonconforming uses is lost when an <br />existing mobile home is replaced, the park owner will have a strong <br />economic incentive to keep all old homes in place and refuse entry <br />of newer mobile homes. If he replaces the older homes with new, <br />the park owner must suffer the loss of half or more of the mobile <br />home sites and the resulting loss of half or more of the parks <br />income and value to make way for compliance with the spacing and <br />parking requirements of the ordinance. <br />The interpretation of the ordinance urged by the park owner <br />will eliminate the incentive to keep old mobile homes in place and <br />permit him to engage in a systematic plan to upgrade and improve <br />the mobile home park by the routine replacement of old mobile home <br />with newer, more safe and more attractive mobile homes. <br />14 <br />
