C.U.P. <br /> �-./vim, •r- <br /> WHEREAS, The Town Board of the Town of MIDDLETON, having considered <br /> said Conditional Use Permit, be it resolved that said permit is hereby <br /> APPROVED SUBJECT TO THE FOLLOWING CONDITIONS: <br /> • Mineral extraction being limited to use for landfill closure <br /> plan; <br /> • The applicant obtaining a report from a forester employed by a <br /> government agency to obtain recommendations for preservation of <br /> larger/older trees in the wooded area defined for potential <br /> extraction; and to not proceed with extraction unless: <br /> •• said recommendations are to be followed, or <br /> •• recommendations are waived by the Town of Middleton Board; <br /> • Approval of a Borrow Area Closure Plan by the Town Engineer; <br /> • A Letter of Credit in the amount and term recommended by the <br /> Town Engineer; <br /> • Grant of right of entry by the applicant to the Town of Middleton <br /> to implement the Borrow Area Closure Plan if necessary; <br /> • and, all other conditions/agreements the applicant, or his <br /> agents have have entered into with other governmental agencies. <br /> I, KENNETH V.
