PETITION NO. 3774 <br /> PETITION TO AMEND THE TEXT OF THE DANE COUNTY ZONING ORDINANCE. <br /> TO THE DANE COUNTY BOARD OF SUPERVISORS: <br /> Ladies & Gentlemen: <br /> The undersigned hereby petitions the Dane County Board <br /> of Supervisors to amend the text of the Zoning Ordinance as follows: <br /> Item: 1) . Delete Section 10.126 (2) (a) 6. <br /> 1210,4000 OX/09s7000,00A/0 04000/ /AgAL OX AX/0 / 0 <br /> 000/XXXX/OAX¢XXAX/OX/sig4 00 /0/ 00A/XXOW zWOOP XY/$$ <br /> Item: 2) . Renumber Sections 10.126 (2) (a) 7 & 8 to 10.126 ( 2) (a) 6 & 7 <br /> respectively. <br /> Item: 3) . Amend Section 10.126 (2) (a) 7. as follows: <br /> 7. Portable cement batch or mixing plants or portable hot mix <br /> blacktop plants used in connection with a highway improvement or <br /> construction project do not require a conditional use permit. <br /> Material produced by such a plant shall be used only for the <br /> • project and sale or use of material at any other location will <br /> require a conditional use permit. The temporary plant facility <br /> shall be located in the proximity of the pertinent highway project. <br /> EXPLANATION: <br /> Item #1: This section currently allows incidental mineral extraction with no <br /> regulation for land leveling activities on agricultural land. The effect of <br /> the amendment would be to require a conditional use permit for the project. <br /> Item 12: Self explanatory. <br /> Item #3: This section currently allows a temporary batch plant to qualify <br /> regardless of location.
