WHEREAS, Madison General Hospital <br /> is/are <br /> - the owner or owners of the following described land in the Town of <br /> Verona , Dane County, Wisconsin, to-wit: <br /> That part of the E 1/2 SE 1/4 Section 3, Town of Verona, lying <br /> Southeasterly of Raymond Road. <br /> 2. WHEREAS, the said owner desires to place certain restrictions thereon, to <br /> bind the owner and those who may acquire title hereafter; <br /> 3. NOW, THEREFORE, in consideration of the mutal benefits passing to and from the <br /> owner and those who may hereafter purchase said land and the parties named as <br /> beneficiaries of these restrictions, the following restrictions are hereby im- <br /> posed: <br /> 1) . Said property shall not be divided. <br /> 2) . That Madison General enter into a written agreement with the Town of <br /> Verona to make an annual payment-in-lieu of taxes for local services <br /> provided by the town; <br /> 3) . That the development plan for the facility provide for preservation <br /> of natural drainageways on the property, and that erosion control during <br /> construction follow an approved soil Conservation Service Plan; <br /> 4) . That any proposed access onto Raymond Road be approved by the Town <br /> Board. <br /> 5) . That the proposed amendment to the zoning district map shall take <br /> effect on a date occurring within six (6) months of the date of County <br /> Board approval of the amendment when the first on-site inspection for • <br /> building location is made and approved for the project sought to be <br /> established. <br /> These restrictions shall constitute covenants running with the land and shall <br /> be binding upon all parties now owning any part of said land, their successors, <br /> heirs and assigns, and all parties holding under them unless, pursuant to para- <br /> graphs 5 or 6 of this instrument, said restrictions are amended or terminated. <br /> - 1 - <br />
