FEB 201987
MEMORANDUM
To: Dane County Agriculture, Environment & Land Records Committee
From: Thomas L. Smiley
Re: Supplemental Comments - From Hearing of February 10, 1987
Date: February 20, 1987
Petition #3868
The arguments get very emotional in this type of case:
- The farmer has been there, and had his pit a long time. No one
denies his right to his own use of the silage pit .
The subdivision, divided from the farm was allowed prior to the
town plan. They bought their lots and homes in good faith.
- The commercial hauler , apparently left Cottage Grove, after
creating a problem with neighbors there. He Is making use of
what would otherwise be an industrial waste, however the
location is the problem. Because it is a commercial use, it
becomes a zoning Issue.
One way to consider this would be If no use were established here, would
the committee approve this for agribusiness zoning? Here are the factors
to consider :
1 . Plan consistency. The Town of Windsor Plan is structured to not
allow even agricultural business uses in the agricultural
preservation area, but does provide for them in a rural-
nonresidential area. Thus a plan amendment Is required. This
Is more cumbersome than some town plans, but that Is the way it
stands now.
RPC
