Smiley <br /> Re: Supplemental Comments - From Hearing of February 10, 1987 <br /> Date: February 20, 1987 <br /> Petition #3868 <br /> The arguments get very emotional in this type of case: <br /> - The farmer has been there, and had his pit a long time. No one <br /> denies his right to his own use of the silage pit . <br /> The subdivision, divided from the farm was allowed prior to the <br /> town plan. They bought their lots and homes in good faith. <br /> - The commercial hauler , apparently left Cottage Grove, after <br /> creating a problem with neighbors there. He Is making use of <br /> what would otherwise be an industrial waste, however the <br /> location is the problem. Because it is a commercial use, it <br /> becomes a zoning Issue. <br /> One way to consider this would be If no use were established here, would <br /> the committee approve this for agribusiness zoning? Here are the factors <br /> to consider : <br /> 1 . Plan consistency. The Town of Windsor Plan is structured to not <br /> allow even agricultural business uses in the agricultural <br /> preservation area, but does provide for them in a rural- <br /> nonresidential area. Thus a plan amendment Is required. This <br /> Is more cumbersome than some town plans, but that Is the way it <br /> stands now. <br /> RPC <br />
