The Town Board agreed to drop the speed limit to <br /> 30-35 mph but later found out that this cannot be done . <br /> On a second point, while there were arguments over details <br /> and side issues, everybody agreed that the Town Dump currently <br /> burns its refuse and will continue to do so until at least late <br /> 1988. This surely creates problems of smoke which particularly <br /> affects families with asthma and other health problems. Dust <br /> from a sandpit and trucks on the private road to the pit will <br /> worsen things. The dump also draws alot of traffic on the two <br /> days a week it is open. <br /> While there were no substantive reactions from the three <br /> Ag/Zoning Committee members who were present, I sensed the <br /> appreciation that the concerns of the neighbors are serious and <br /> legitimate and that these concerns have to be positively <br /> addressed with enforceable conditions , if this application is to <br /> receive a favorable vote on rezoning and conditional use . <br /> The Town Board expressed great confidence in the operator , <br /> Mr. Peck and this we do not dispute . Partly because of this <br /> confidence and partly because the Town is an advisory entity with <br /> regard to a County rezoning and County conditional use , the Town <br /> Board was inclined to speak in terms of loose , not legally <br /> binding guidelines, and waivers of performance guarantees. We <br /> hope the County will be more firm in realization that the zoning <br /> "runs with the land" and with realization that you have to be <br /> concerned with setting precedent, not just for Mr . Peck, but for <br /> the entire County. <br /> We have been informed by your staff that this matter likely <br /> come up at your June 23 work session. Between now and then, I <br /> intend to draft and to submit a list of conditions working from <br /> the County Ordinance and looking also at recent Conditional Use <br /> matters for sand and gravel operations elsewhere in the County. <br /> I think that the May 28th session was worthwhile in bringing <br /> the issues into focus and in understanding more precisely the <br /> factual basis for the many concerns of the neighbors .
