Zoning Department <br /> February 2, 1987 <br /> Page 2 <br /> business which were constructed on the property <br /> following a zoning change to LC-1 Limited Commercial <br /> District in 1978. The change to LC-1 Limited Commercial <br /> District zoning, however, was made subject to certain <br /> deed restrictions applicable to the above-described <br /> property which are set forth in full in the copy of the <br /> recorded Deed of Restrictions attached to and made a <br /> part of this petition. The Deed of Restrictions recites <br /> that the premises will be used only for the use <br /> permitted in an R-1 Residence District, except that in <br /> addition to such uses, the premises may be used for the <br /> storage, parking, maintenance and repair of school <br /> buses, and no other use may be made of the premises. <br /> The area of the land affected by the Deed of <br /> Restrictions is 1 . 5 acres. <br /> After Mr. Bailey' s school bus contract with the <br /> Verona area school district terminated, Mr . Bailey found <br /> a tenant who now occupies the premises, namely <br /> Richardson Bus Service, Inc. , which tenant uses the <br /> property for the storage, parking, maintenance and <br /> repair of school buses . Mr . Bailey would like to sell <br /> the property to Richardson Bus Service, Inc. and <br /> Richardson Bus Service, Inc. is interested in the <br /> possible purchase of the property, but is unwilling to <br /> do so with the current deed restrictions which make the <br /> property virtually unmarketable should Richardson decide <br /> to sell the property at some future date. Mr . Bailey <br /> believes that no purchaser would be willing to purchase <br /> the property at a reasonable price with the current deed <br /> restrictions limiting the use of the property to that of <br /> the storage, maintenance and parking of school buses . <br /> The Deed of Restrictions specifically provides that <br /> the restrictions may be terminated through County Board <br /> approval of a petition for termination of the <br /> restrictions under procedures set forth in the deed of <br /> restrictions. This letter constitutes Mr . Bailey' s <br /> petition for termination of the restrictions on the <br /> subject property as set forth in the Deed of <br /> Restrictions recorded November 9, 1978 in Volume 1012 of <br /> Records, page 240, Document No. 1599718. The effect of <br /> the removal of the restrictions would leave the property <br />
