WHEREAS, pursuant to the approvals granted under Dane County Zoning Ordinance Amendment <br /> #8623, the owner(s) of the above described land placed restrictions on said property limiting the <br /> agricultural business and limited commercial uses on the property found under Register of Deeds <br /> Document #3806289, recorded on September 9, 2003. <br /> WHEREAS, the owner(s) of the subject property submitted a written petition under Dane County Zoning <br /> Ordinance Amendment#11048 to change the zoning district classifications of the above described <br /> property and calling for the amendment of the restrictions in document #3806289 to allow the expansion <br /> of agricultural business and commercial uses (retail sales of nursery stock and related landscaping <br /> materials produced on the property, and the operation of a landscape and gardening business). <br /> WHEREAS, following the submittal of petition #11048, and after holding a public hearing, the Town <br /> Board of the Town of Cottage Grove, the Dane County Board of Supervisors, and the Dane County <br /> Executive approved the requested zoning map amendment and amendment of the restrictions. <br /> WHEREAS, approval of zoning map amendment was published on December 1, 2016. <br /> THEREFORE, the previous restrictions, recorded in document#3806289, attached herein as Exhibit <br /> A, are hereby amended and replaced by the following restrictions on the above-described property: <br /> 1. Uses of the A-B Agricultural Business and C-1 Commercial zoned areas described above are <br /> limited exclusively to: retail sales limited to nursery stock produced on the property, bagged <br /> soil, compost, and fertilizer; and operation of a landscape and gardening business. <br />
