Anderson: <br /> On behalf of my client , Frank Musillami , I am writing to urge your <br /> committee to vote in support of the proposed rezoning of the Musillami <br /> land on Airport Road , Town of Middleton, from A-1 to LC-1 . <br /> I have been advised by Ed Tallard , Town Chairman, that the Town Board <br /> voted against this rezoning at its meeting on July 13. The alleged <br /> reasons for rejection were that the property is located too close to <br /> residential property , and that truck access onto Airport Road would <br /> cause traffic problems . These "problems" were never discussed with me <br /> or my client and are mere pretenses for denial of a legitimate rezoning <br /> request . Mr . Musillami has expressed his willingness to abide by <br /> restrictions on the number of vehicles to be stored on the property , <br /> and has indicated his willingness to store vehicles only in the <br /> existing building . <br /> It is interesting to note that earlier this year a similar rezoning <br /> request , petition no . 3849 , was granted to rezone from A-i to LC-1 <br /> after the owner had commenced construction of a storage facility for a <br /> dump truck , which facility could not legally be constructed in an A-1 <br /> district . <br /> In addition to the questionable denial of a request for rezoning , I <br /> also take exception to the manner in which this petition has been <br /> handled . After my letter to Kenneth Biller of May 22 ( a copy of which <br /> was previously provided to you) , I was invited to appear at the Town <br /> Board meeting of June 8 to discuss this matter . I appeared , <br /> accompanied by Mrs. Musillami , and responded to all questions <br /> presented . At that meeting , Mr . Tallard raised concerns that the <br /> proposed LC-1 zoning not accompany the land upon sale, but that it <br /> revert to A-1 at that time. I indicated that the Musillami ' s were <br /> agreeable to this because they wish to make use of the existing <br /> facility on their land at this time. <br /> Mr . Tallard indicated that he would discuss that means for assuring <br /> reversion of the zoning , as well as the possibility of rezoning only <br /> that part of land where the building is located , with Mr . Scribner . <br /> Mr . Tallard said he would contact me thereafter . <br />
