Biller :
I represent Frank Musillami , owner of the property located near the
intersection of Airport Road and Capitol View Road in the Town of
Middleton. A petition for rezoning this property from A-1 Agricultural
to LC-1 Limited Commercial was filed with Dane County Zoning Department
on March 12, 1987. At that time, I was advised by the staff of the
Dane County Zoning Department to contact you in order to make
arrangements for a meeting to discuss the request for rezoning . That
day I contacted you at the phone number I was given, 836-1324. I was
advised that I snould contact Dave Kollasch to arrange for a meeting
before the Town Planning Commission. I appeared before the Town
Planning Commission on Wednesday, April 1 , 1987. Although there was no
quorum present at the meeting , I was advised that the matter would be
approved at the May meeting . It was suggested to me that I contact the
neighbors and advise them of the request for rezoning . By letter dated
April 17, 1987, I did contact all of the neighbors. I received no
response from them other than a letter from David Crocker , President ,
Midland Builders. A copy of that letter is enclosed .
On May 12, 1987, I appeared before the Dane County Agriculture,
Environment and Land Records Committee in support of the rezoning
petition. There were no other appearances, either in support or
against the petition. I was advised at that time that the Town of
Middleton had not yet advised the Agriculture, Environment and Land
Records Committee of their decision. I proceeded to contact Dave
Kollasch witn regard to this. matter . Inasmuch as I was unable to reach
him by telephone, I sent a letter to him. On May 21 , I spoke with the
zoning office and was advised that they had received information that
the Town Board had taken action on May 16 and disapproved the petition
for rezoning . I have attempted to reach you by telephone but have been
unable to do so .
In speaking with Dave Kollasch on May 22, I was advised the the Town
Planning Committee never took action on this matter and , in fact , did
not receive the paper work until after the meeting of the Town Board at
which action was, apparently , taken to disapprove the rezoning .
