• <br /> - RESTRICTIONS - <br /> 1. WHEREAS, is/are <br /> the owner or owners of the following described land in the Town of <br /> , Dane County, Wisconsin, to-wit: <br /> Part of the SE1/4 SW1/4 of Section 16, Town of Cottage Grove described as <br /> follows: Commencing at the Southwest corner of the SE1/4 SW1/4 of Section 16, <br /> going North 1075 feet; thence Easterly 773 feet; thence South 225 feet; thence <br /> West 350 feet; thence South 850 feet; thence West along centerline of Coffey <br /> Town Road 423 feet to point of beginning. <br /> 2. WHEREAS, the said owner desires to place certain restrictions thereon, to <br /> bind the owner and those who may acquire title hereafter; <br /> 3. NOW, THEREFORE, in consideration of the mutal benefits passing to and from the <br /> owner and those who may hereafter purchase said land and the parties named as <br /> beneficiaries of these restrictions, the following restrictions are hereby im- <br /> posed: <br /> a) . A retention pond shall be constructed as follows: <br /> 1. The pond shall be located a minimum of 75 feet from the <br /> right-of-way of Coffeetown Road. <br /> 2. The pond shall be a minimum of 1/2 acre in area with a minimum <br /> depth of 4 feet. <br /> 3. An overflow pipe shall be installed to drain from the South <br /> west corner. <br /> These restrictions shall constitute covenants running with the land and shall <br /> be binding upon all parties now owning any part of said land, their successors, <br /> heirs and assigns, and all parties holding under them unless, pursuant to para- <br /> graphs 5 or 6 of this instrument, said restrictions are amended or terminated. <br /> - 1 - <br />
