•
; \&;a- 91ceL-
€. ''', OFFICE OF THE
wq, I CORPORATION COUNSEL
M E M O R A N D U M
* * * *
TO: Norb Scribner , Bill Fleck , Gene Rankin, John Norwell
FROM: Cal Kornstedt
RE: Menard ' s
DATE: November 4 , 1987
As each of you knows (with the exception of John) ,
Lyman Anderson has asked whether the Transportation
Committee ' s conditions on Menard ' s Controlled Access
Application of April 3, 1987 are still valid in light of the
action of the county board in approving Menard ' s zoning
petition . It seems to me at this point that these are
separate actions and that the one does not depend on the
other . In other words, the actions of the Transportation
Committee are separate and independent of the issues
presented in the zoning petition. It is my recollection
that at the county board meetings on this subject the issue
of access points was specifically pointed out as being
separate and distinct from the zoning action. At any rate ,
I do not now see any effect of the one on the other (either
way) . If any of you have a different opinion, please let me
know, and include the basis for your opinion.
Lyman ' s letter indicates each of you received a copy,
except John. For him, I enclose a copy. If any of the rest
of you do not have a copy, please let me know.
5420a
419 City-County Building, 210 Monona Avenue, Madison, Wisconsin 53709 608/266-4355
