DANE COUNTY ORDINANCE AMENDMENT NO. 7585 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Burke. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Burke be amended to include in the C-2 Commercial District/s the <br /> following described land: <br /> PETITION NUMBER: 7585 <br /> Part of the SE 1/4 SE 1/4 Section 23, Town of Burke, described as follows: Commencing <br /> at the Northeast corner of said SE 1/4 of the SE 1/4; thence S89°05'04" West along the <br /> North line of said SE 1/4 of the SE 1/4, 178.98 feet to the point of beginning. Thence <br /> S00°53'03" West, 133.38 feet parallel with the East line of said SE 1/4 of the SE 1/4; <br /> thence S89°0504" West, 18.00 feet; thence S00°53'03" West, parallel said East line <br /> 110.00 feet; thence N89°05'04" East, 196.98 feet to a point on said East line, thence <br /> S00°53'03" West along said East line 20.00 feet; thence S89°05'04" West,208.83 feet; <br /> thence S00°53'03" West, 30.00 feet; thence S89°05'04" West, 118.82 feet; thence <br /> S00°53'03" West, 178.70 feet; thence S89°05'04" West, 90.00 feet; thence N00°53'03" <br /> East, 208.70 feet; thence 589°05'04" West parallel with the North line of said SE 1/4 of <br /> the SE 1/4 to a point on the West line of said SE 1/4 of the SE 1/4; thence North along <br /> said West line 263.38 feet to the Northwest corner of said SE 1/4 of the SE 1/4; thence <br /> N89°05'04" East along the North line of said SE 1/4 of the SE 1/4 to the point of <br /> beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of <br /> the land shall record the following restrictions on said land: <br /> 1). That the applicant obtain a storm water run-off and control plan from the Town of Burke Town Board by <br /> October 31, 1999 and also have approval from the Dane County LCC. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the owners of land <br /> within 300 feet of the site. Failure to record the restrictions will cause the rezone to be null and void. <br /> A copy of the recorded document shall be submitted to Dane County Zoning. <br /> f)\\()\1(3\ <br /> `` <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be <br /> consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
