Conditional Use Permit 1575: I. Compliance with Ordinance Standards: Section 10.255(2)(h)2 of the Dane County Zoning Ordinance requires that,prior to approving a conditional use,the ZNR must find that: That the uses,values and enjoyment of other property in the neighborhood for purposes already permitted shall be in no foreseeable manner substantially impaired or diminished by establishment,maintenance or operation of the conditional use. The property in question borders on the Military Ridge State Trail,a popular biking/hiking trail through a regionally significant scenic resource in Dane County. An argument could be made that without appropriate conditions,the proposed dog kennel could create visual,noise or other nuisance conflicts with the enjoyment of the trail by bicyclists and hikers. Suggested conditions of approval: Prior to issuance of any associated zoning permits,the landowner must submit and implement a plan to establish a buffer of perennial vegetation between the proposed dog kennel site and the Military Ridge Trail. Such buffer shall effectively screen the proposed development from view from the trail within 5 years. Prior to issuance of any associated zoning permits,the landowner must submit a manure storage and disposal plan that complies with applicable sections of the Dane County Manure Storage Ordinance and is approved by the County Division of Environmental Health. Any buildings shall be painted in neutral,earth-tone colors to minimize visual impact. Fences,runs and kennel operations shall be maintained in good condition and shall keep animals appropriately contained.
