DEED RESTRICTION V n U 9 <br /> 2. The following CUP uses, as derived from the Dane County Code of <br /> Ordinances s. 10.126 (3), Conditional Uses Permitted in the A-2 <br /> District: <br /> (o) kennels, horse boarding stables, riding stables, hay and sleigh <br /> rides, horse shows and similar events; <br /> (p) unlimited livestock on.3 to 16 acres; <br /> (q) sale of agricultural and dairy products not produced on the <br /> premises and incidental sale of pop and candy; <br /> (s) retail sales of bridles, saddles, grooming supplies and related <br /> items at a horse boarding or riding stable facility (said use <br /> shall be limited to a maximum of 150 sq. ft. of floor space) ; and <br /> training of dogs at a dog kennel or training of horses at a horse <br /> boarding facility. <br /> 3. Erosion control plan for the proposed 46,400 s.f. stable and <br /> indoor riding area, if built, to be approved by the Dane County <br /> Land Conservation Department. <br /> 4. Stormwater management plan for the long-term safe conveyance of <br /> water on the site, to be completed only if the 46,400 s.f. stable <br /> and indoor riding arena is constructed, to be approved by the Dane <br /> County Land Conservation Department; this condition could be <br /> included as an element of the aforementioned erosion control plan. <br /> These restrictions shall constitute covenants running with the land <br /> and shall be binding upon all parties now owning any part of said <br /> land, their successors, heirs and assigns, and all parties holding <br /> under them unless, pursuant to paragraphs 5 or 6 of this <br /> instrument, said restrictions are amended or terminated. <br /> IV. The restrictions provided for herein shall be enforceable at law or <br /> equity against any party who has or acquires an interest in the <br /> land subject to the restriction by the following parties who are <br /> named as grantees, promisees and beneficiaries with enforcement <br /> rights: <br /> (a) The County Government of Dane County, Wisconsin provided that the <br /> lands are under the jurisdiction of zoning ordinance of said County <br /> at the time the enforcement action is commenced; and <br /> (b) The Town Government of the Town `fc Dane County, Wisconsin <br /> provided that the lands are within the governmental jurisdiction of <br /> said Town at the time the enforcement action is commenced. <br />
