Your first question <br /> is wheth:r the county':. practice of requiring deed restrictions as a condition of <br /> rezonin is lawful. You indicate that in particular you are interested in this practice <br /> as it rel tes to requiring deed restrictions on (a) land of the petitioner other than that <br /> included in the particular parcel being rezoned and (b) lands owned by other than <br /> the petit oner. In my opinion, a deed restriction may be required as a condition of a <br /> rezone c n any land without regard to the ownership of the lands to be restricted and <br /> regardle 3s of whether the restricted lands are part of the land subject to the rezone. <br /> C Dnditional zoning is not expressly described or endorsed in the statutes. <br /> But, it is expressly recognized in the common law of Wisconsin. In State ex rel. <br /> Zupanci ;v. Schimenz 46 Wis.2d 22 (1970), the Wisconsin Supreme Court <br /> recogni2 ed the legality of conditional zoning, which it defined as an adopted zoning <br /> ordinance which provides either: (1) The rezoning becomes effective immediately <br /> with an :tutomatic repealer if specified conditions are not met within a set time limit, <br /> or(2) th? zoning becomes effective only upon,the conditions being met within the <br /> time Jim,!." Id., at 30 (emphasis added) In Konkel v. Delafield Common Council, 68 <br /> Wis.2d :,74, 229 N.W.2d 606 (1975), the Supreme Court again recognized the <br /> validity c f conditional zoning: <br /> We conclude that the ordinance is of the first type <br /> describe) - that it does not become effective and that <br /> there is no rezoning to R-5 until the conditions of the <br /> ordinance are met. As so viewed, the validity of the <br /> ordinance is free from doubt.
