DANE COUNTY ORDINANCE AMENDMENT NO. 7599 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Berry. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Berry be amended to include in the RH-1 and RH 3 Rural Homes <br /> Districts the following described land: <br /> PETITION NUMBER: 7599 <br /> TO RH-1: <br /> Being part of the NE 1/4 of the SE 1/4 Section 21, Town of Berry described as follows: <br /> Commencing at the East quarter corner of said Section 21; thence South along the East <br /> line of the Southeast quarter of said Section 21, 1317.45 feet. thence N89°33'52" West <br /> along the South line of the NE 1/4 of the SE 1/4 of said Section 21, 335.62 feet to the <br /> point of beginning;thence continuing N89°33'52"West along the South lineof the NE 1/4 <br /> of the SE 1/4 of said Section 21, 326.85 feet; thence N00°02'52" East, 718.44 feet to a <br /> point on the centerline of Pine Road; thence N47°06'02"East along the centerline of Pine <br /> Road, 90.17 feet; thence S00°02'52" West, 469.51 feet; thence S89°33'52" East, 243.62 <br /> feet;thence S03°07'26"East, 31 1.40 feet to the point of beginning. <br /> TO RH-3: <br /> Being part of the NE 1/4 of the SE 1/4 of Section 21, Town of Berry, described as <br /> follows: Commencing at the East quarter corner of said Section 21; thence South along <br /> the East line of the Southeast quarter of said Section 21, 117.29 feet to the point of <br /> beginning; thence continuing south along the East line of the Southeast quarter of said <br /> Section 21, 1,200.16 feet; thence N89°33'52" West along the South line of the NE 1/4 of <br /> the SE 1/4 of said Section 21; 335.62 feet; thence NO3°07'26" West, 311.40 feet; thence <br /> N89°33'52' West, 243.62 feet; thence N00°02'52' East, 469.51 feet to a point on the <br /> centerline of Pine Road; thence N47°06'02" East along the centerline of Pine Road, <br /> 583.89 feet; thence Northeasterly along a 1,329.00 foot radius curve to the left in the <br /> centerline of Pine Road, having a central angle of 03°50'46" and whose long chord bears <br /> N45°10'39" East, 89.19 feet; thence S46°44'44" East,33.00 feet to a point in the <br /> Southeasterly right-of-way line of Pine Road; thence S74°29'13" East, 83.83 feet to the <br /> point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3Xa)2.(b)of the Dane <br /> County Code of Ordinances. The rezoned area shall be subject to the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description/s is/are intended to describe land for which a certified survey map <br /> will be prepared for approval and recorded. This amendment will become effective, if within <br /> 90 days of its approval by Dane County, a certified survey map that describes the land to be <br /> rezoned is recorded in the office of the Dane County Register of Deeds. Failure to record the <br /> survey will cause the rezone to be null and void. Two copies of the recorded survey shall <br /> be submitted to Dane County Zoning. <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be <br /> consistent with the provisions of Wisconsin State Statute 91.77(1)0),(b),(c). <br />
