COMPOSITE REPORT—Page 2 ITEM # 3— APPLICATION 7604 <br /> ZNR Public Hearing 7/27/99 Stanley Rauls (Terry Wenger, agent) <br /> Windsor 11 <br /> STAFF COMMENTS <br /> Background <br /> A-1 EX to C-2 <br /> Terry Wenger operates Tri-County Paving, Inc. on a 2.6 acre C-2 zoned parcel, under the <br /> following Rezones/CUP's: <br /> a. Pet 4640, effective 02/06/1990, rezoning 2.07 acres from A-1 to C-2, was approved <br /> with a Deed Restriction stating that"Commercial use of this property shall be limited <br /> to a paving contractor business." The resulting CSM showed a frame dwelling, small <br /> shed, and large shed. A more recent site plan for this area shows that a 60'x80' <br /> "Shop" building has been added since; <br /> b. CUP 787 for a Residence for Watchman/Caretaker was filed in conjunction with Pet. <br /> 4640, and became effective 09/24/1990; <br /> c. Pet. 5088, effective 09/24/1991 added a 0.50 acre strip of land to the rear, or West, of <br /> the CSM, and also included the above Deed Restriction. A recent site plan shows that <br /> this area is currently used as "Black Top", with no buildings. <br /> The current Petition would transfer a 100'x421', 0.96 acre, strip of land on the North side <br /> of the C-2 zoned parcels from Raul's 180 acre farm to Wenger. The total C-2 zoned <br /> parcel would then be 3.53 acres. Wenger states that"the [added] property would have a <br /> driveway entrance and be used to load & unload equipment" and for parking equipment. <br /> Wenger also proposes to "build one to two sheds for housing equipment...approximately <br /> 50'x100' or larger". <br /> Soils: 100% Class I-II <br /> Uses: 100% Cropland <br /> References inTown Plan <br /> The area to rezone is classified as agriculture in the Town Land Use Plan. Such district is <br /> defined as: <br /> "Long-term productive agriculture and related agribusiness uses <br /> involving cultivation and husbandry. " <br /> The relevant goals of the plan are: <br /> • "Prohibit new commercial land industrial development, except that <br /> which is directly dependent on productive agriculture,from locating <br /> outside of Urban Service Areas. " <br /> • "Require commercial and industrial development to be served by <br /> public sanitary sewer and water systems. " <br />
