VILLAGE OF COTTAGE GROVE BOARD <br /> RESOLUTION 2016-03 <br /> APPROVAL OF WAIVER <br /> OF EXTRATERRITORIAL PLAT APPROVAL JURISDICTION <br /> FOR SUBDIVISION AREA IN THE TOWN OF COTTAGE GROVE, <br /> DANE COUNTY,WISCONSIN <br /> WHEREAS,the Village of Cottage Grove has been requested to consider a potential <br /> single family subdivision plat depicted on Exhibit A (the"Subdivision Area"), a copy of <br /> which is attached hereto and incorporated by reference;and <br /> WHEREAS, as provided in Wisconsin Statutes §236.45, State law provides all villages <br /> and the Village of Cottage Grove with land division authority within its corporate boundaries <br /> as well as extraterritorial plat review jurisdiction;and <br /> WHEREAS, State law also permits waiver of extraterritorial plat review jurisdiction <br /> by resolution of the village board,and the Village Board of the Village of Cottage Grove. <br /> WHEREAS,the Village recognizes that certain characteristics which are unique to the <br /> Subdivision Area make it suitable for consideration of this waiver, including but not limited to <br /> the adjacency of the Subdivision Area to two existing Town subdivisions, the relatively small <br /> size of the Subdivision Area(less than 12 acres), the location of the Subdivision Area as it <br /> adjoins the ETJ boundary and is therefore at a maximum distance from the Village boundary, <br /> the potential for the development of the Subdivision Area to provide aesthetic improvements <br /> and improvements to street connectivity that may benefit the larger Cottage Grove <br /> community,and the minimal potential for Village growth to encroach upon the Subdivision <br /> Area within the current planning horizon;and <br /> WHEREAS, given the unique characteristics of the Subdivision Area described above, <br /> the Village expects the development of the Subdivision Area will not negatively impact the <br /> Village now or in the foreseeable future; and <br /> WHEREAS,granting of this waiver does not imply the approval of any similar <br /> requests in the future. <br /> NOW,THEREFORE,BE IT RESOLVED by the Village Board of the Village of <br /> Cottage Grove as follows: <br /> 1. As provided in Wisconsin Statutes §236.10(5), the Village of Cottage Grove <br /> hereby waives its right to approve the proposed plat within that portion of its <br /> extraterritorial plat approval jurisdiction in the Town of Cottage Grove depicted <br /> as the Subdivision Area on the Town Map attached hereto as Exhibit A, which <br /> Subdivision Area is legally described as set forth in the attached Exhibit B, <br /> both of which are incorporated by reference. <br />
