You presented a site plan for a proposed agricultural use <br /> building, to be located south of the Sugar River, which flows through this property. The site plan <br /> was apparently part of your Shoreland Erosion Control Permit application for the proposed barn <br /> and adjacent proposed driveway -- SE2006-0233, approved 10/04/2006. <br /> Zoning Division review identified a floodplain associated with the river. I advised you that unless <br /> your barn could be located outside of the floodplain, a Floodzone Development Permit would be <br /> required. I also mentioned that there is a minimum 75 foot setback from the Ordinary High <br /> Water Mark [OHWM] of the river. Our discussion, centering on how you could locate the barn to <br /> avoid the Floodzone Permit and meet the 75 foot setback, included my instructions and <br /> comments as follows: <br /> 1) Maintain the location of the proposed driveway serving the proposed barn. On your site <br /> plan, this driveway appears to be located about 150 feet north of the intersection of the <br /> driveway to your residence and Domini Road. <br /> 2) Center the 75 foot side of the proposed barn on the driveway as located in 1), so that the <br /> 200 foot side of the barn extends to the east. <br /> 3) Prepare a new site plan showing the proposed 75'x200' barn located as described in 1) and <br /> 2). <br /> 4) If the proposed barn is located as in 2) and 3), it appears that it will meet the minimum 75 <br /> foot setback from the OHWM and will not be located within the floodplain of the Sugar River. <br /> 5) Because the proposed 75'x200' barn is a different length and width than the undimensioned <br /> barn shown for SE 2006-0233, you must provide a copy of the new site plan, including <br /> revised erosion control measures, to the Dane County Land Conservation Division and <br /> obtain approval of this revision to your Shoreland Erosion Control Permit. Please contact <br /> Jess Starks, Erosion Control Inspector at 224-3647. <br /> During our discussion, you mentioned that the proposed barn may be used for horse boarding. <br /> Horse boarding is allowed only under a Conditional Use Permit [CUP] in the A-1 EX Exclusive <br /> Agricultural district (Section 10.123(3)(g) Dane County Code of Ordinances [DCCO]). There is <br /> currently no CUP for horse boarding on the A-1 EX portion of your farm. However, as part of my <br /> review, I discovered that you had applied for a horse boarding CUP for the 3.4 acre A-2(2) <br /> portion of your property in 2003.
