Proposed Conditional Use Permit # 2371 <br /> In order for an applicant to obtain a Conditional Use Permit, the Zoning and Land Regulation <br /> Committee must find that all of the following standards are met for the proposed land use: <br /> 1. The establishment, maintenance, or operation of the conditional use will not be detrimental to or endanger the public <br /> health, safety, comfort or welfare. <br /> 2. The uses,values and enjoyment of other property in the neighborhood for purposes already permitted shall be in no <br /> foreseeable manner substantially impaired or diminished by establishment, maintenance or operation of the <br /> conditional use. <br /> 3. The establishment of the conditional use will not impede the normal and orderly development and improvement of <br /> the surrounding property for uses permitted in the district. <br /> 4. Adequate utilities, access roads, drainage and other necessary site improvements have been or are being made; <br /> and <br /> 5. That adequate measures have been or will be being taken to provide ingress and egress so designed as to <br /> minimize traffic congestion in the public streets; and <br /> 6. That the conditional use shall conform to all applicable regulations of the district in which it is located. <br /> Staff has prepared a list of conditions that may be used in order to meet the six standards as listed <br /> above to allow the conditional use on the property. Please note that the conditions may need to <br /> be changed or additional conditions added to address potential nuisances that may come to light <br /> during the public hearing. <br /> 1. The applicant shall submit an erosion control plan covering the area to be disturbed and receive <br /> approval of an erosion control permit prior to commencing extraction operations. <br /> 2. The applicant shall apply for and receive all other required local, state and federal permits. <br /> 3. The operator shall develop and operate the site according to the site/operations and phasing plan <br /> submitted for this proposal and dated December 2001. <br /> 4. Operations shall cease no later than twenty-five (25) years from the date of CUP approval. <br /> 5. Reclamation shall meet requirements of Chapter 74 of the Dane County Code of Ordinances. <br /> 6. An undisturbed area between the eastern boundary of the CUP area and the boundary of the quarry <br /> expansion area shall be maintained as shown on the operations plan. <br /> 7. Screening will be achieved with berms and vegetation in preparation for eastward expansion of the <br /> quarry. <br /> 8. The driveway accessing the site shall be paved. The operator shall maintain the driveway in a dust free <br /> manner in accordance with local, state, and federal regulations, and shall clean any dust or mud tracked <br /> onto public roads. <br /> 9. The operator and all haulers shall access the CUP site only through those points designated as <br /> entrances on the site/operations plan. <br /> 10. The access to the driveway shall have gates securely locked when the extraction site is not in <br /> operation. The site shall be signed "no trespassing." <br /> 11. There shall be a minimum setback of 20' from the property line. Berms may be contained within this <br /> setback area. <br /> Continued.... <br />
