The property is located in the town's Agricultural Preservation District, where the density of non- <br /> farm residential development is limited to 1 lot or non-farm use (aka "split") per 35 acres of land owned as of <br /> May 3, 1979. The property was owned by Mrs. G.J. Johnson and totaled approximately 55 acres as of May 3, <br /> 1979. <br /> Based on the town's density policy, the farm remains eligible for one (1)possible split. The original, pre-1979 <br /> farm house located at 1842 State Highway 73 was separated from the farm in 2003 per rezone petition #8468 <br /> and Certified Survey Map #10749. That rezoning petition was conditioned upon the recording of a deed <br /> restriction prohibiting further development on the property. Since that time, the town has clarified its policy that <br /> separation of residences existing prior to May 3, 1979 does not count as a split toward the density limitation. As <br /> a result, one possible split still remains on the property. Although you do not currently have any plans to create <br /> a new residential parcel, please note that any future development on the property would need to be reviewed by <br /> the town of Christiana for consistency with their comprehensive plan. Please also note that the existing deed <br /> restriction on the property can be lifted as part of a future proposed rezoning petition. <br /> This density analysis does not preclude or guarantee town or county approval of a particular land division, <br /> rezone, or development proposal. The Town of Christiana Plan Commission and Board of Supervisors review <br /> all applications to rezone, and apply interpretations, standards and criteria as set forth in the town land use plan <br /> to guide their decisions. Such standards include considerations for soil type, environmental features, site <br /> characteristics, compatibility with neighboring uses, proposed location of driveways and utility extensions, and <br /> proposed lot size and location. In addition, all rezones are subject to county Zoning Committee, Board, and <br /> Executive approval.
