The property is located in the town's Agricultural Preservation Area, within which
the density of residential development is limited to no more than one residence (a/k/a density unit or
"split") per 40 acres owned as of July 1, 1979. A search of the relevant deeds to the property reveal that
the property was owned by James E. Carley and totaled approximately 135 acres as of 7/1/79.
As indicated on the report, four(4) splits have been taken on the property, including the A-2 zoned parcel
that you own (CSM 5599). The four splits exceeds by one the total allowed under the town density
limitation. As a result, the property is not eligible for any additional splits.
Please note that this density analysis does not preclude or guarantee town or county approval of a
particular land division, rezone, or development proposal. The Town of Dunkirk Plan Commission and
Board of Supervisors review all applications to rezone, and apply interpretations, standards and criteria
as set forth in the town comprehensive plan to guide their decisions. Such standards include
considerations for soil type, environmental features, site characteristics, compatibility with neighboring
uses, proposed length and location of driveways and utility extensions, and proposed lot size and
location. In addition, all rezones are subject to Town Board, County Board, and County Executive
approval. .
If you have any questions about this density analysis, please contact me by phone at 267-2536, or by
email at allanCacountvofdane.com.
Sincerely,
Majid Allan
Senior Planner
cc: Melanie Huchthausen, Clerk, Town of Dunkirk (by email)
Kent Falligant, Chair, Town of Dunkirk Plan Commission (by email)
