The property is located in the town's Agricultural Preservation Area, within which <br /> the density of residential development is limited to no more than one residence (a/k/a density unit or <br /> "split") per 40 acres owned as of July 1, 1979. A search of the relevant deeds to the property reveal that <br /> the property was owned by James E. Carley and totaled approximately 135 acres as of 7/1/79. <br /> As indicated on the report, four(4) splits have been taken on the property, including the A-2 zoned parcel <br /> that you own (CSM 5599). The four splits exceeds by one the total allowed under the town density <br /> limitation. As a result, the property is not eligible for any additional splits. <br /> Please note that this density analysis does not preclude or guarantee town or county approval of a <br /> particular land division, rezone, or development proposal. The Town of Dunkirk Plan Commission and <br /> Board of Supervisors review all applications to rezone, and apply interpretations, standards and criteria <br /> as set forth in the town comprehensive plan to guide their decisions. Such standards include <br /> considerations for soil type, environmental features, site characteristics, compatibility with neighboring <br /> uses, proposed length and location of driveways and utility extensions, and proposed lot size and <br /> location.
