01/26/2007 FRI 09:02 FAX 8349999 HEXAGON TITLE Qj010/032 <br /> 000240 <br /> 3.7 Construction of all buildings shall be completed within six (6) <br /> months after issuance of a building permit for the respective building. each lot <br /> owner agrees to install a minimum of two conifers plus two dedduous trees on <br /> their lot and a minimum of six foundation plantings within one year of the <br /> completion of the home. landscaping (including grading, sodding and seeding) <br /> and paving of driveway shall be completed within one hundred and eighty(180) <br /> days of completion of construction, provided weather conditions so allow. If <br /> such construction or landscaping is delayed due to matters beyond the control of <br /> the lot owner, the time for completion shall be extended by the period of such <br /> delay. <br /> 3.8 No land shall be used or maintained as a dumping area for rubbish, <br /> trash, garbage or other waste. <br /> 3.9 (a). No exterior antennas, solar panels, walls or fences shall be <br /> permitted unless approved in writing in advance by the Developer or the <br /> Architectural Control Committee,whichever is then applicable, including approval <br /> of the location, material, height, or color thereof. <br /> (b). There shall be no external heat sources, such as wood fired <br /> boilers, or other external smoke producing heat sources which are being used to <br /> heat any building on the property allowed on any lot at any time. <br /> 3.10 No noxious or offensive trade or activity shall be carried on, nor <br /> shall anything be done which may be or will become a nuisance to the <br /> neighborhood. This shall not be construed to prevent a family garden or <br /> orchard, but all vegetable gardens and orchards shall be located in back or side <br /> yards. <br /> 3.11 No lot as platted shall be re-subdivided. No boundary line within <br /> the Property shall be changed, except with the approval of the Developer or the <br /> Architectural Control Committee, whichever Is then applicable. This section shall <br /> not be construed to prevent the use of one lot and part or all of another lot or <br /> lots as one building site. <br /> 3.12 All buildings constructed on any lots subject to this Declaration <br /> shall conform to all governmental zoning requirements and all side-yard and set- <br /> back requirements imposed by local ordinance. <br /> 3.13 The Developer and Owners of lots in Drovers Woods f=irst Addition <br /> shall be responsible for constructing and maintaining, at no cost to the adjoining <br /> land owner, all fences required by Wisconsin Statutes, Dane County Ordinances <br /> or Town of Sun Prairie Ordinances by reason of the adjoining land being used for <br /> • <br />
