In previous years,air <br /> photos showed a pond located in this farmed area behind the farm residence on the property. This pond <br /> on longer exists and is currently being used for agricultural purposes. While there is no longer bed or <br /> bank or a navigable waterway,wetland areas may exist. Based upon the site inspection the waterway in <br /> question does not meet the state definition of"navigable waterway". <br /> Be advised to consult with your local City or County zoning administrators for other possible restrictions <br /> regarding this proposed work. <br /> This project should also be evaluated with respect to the provisions in NR 216 Wisconsin Administrative <br /> Code. The Department uses NR 216 to review stormwater discharge permits and applies this code to <br /> construction activities that affected five or more acres of land. The purpose of this permit is "to eliminate <br /> to the maximum extent practicable the discharge of pollutants carried by stormwater runoff into water of <br /> the state",NR 216.001 Wis.Adm. Code. Before proceeding with any construction activity, a notice of <br /> intent per NR 216.43 needs to be filed and your project needs to be reviewed by the appropriate <br /> Department staff.
