He and his added the deck without a permit. It is our impression that they all knew they needed a permit to do the work. There was a complaint issued on the construction. We told Tim, he needed a permit. During the process, it was discovered that the deck did not comply with the front setback. A permit was issued with the agreement that 3 feet would need to be removed from the deck. We also provided him with the opportunity to go the BOA to get a variance. He has chosen to do nothing. I reviewed the ordinance with regards to granting waivers for handicap access to facilities. The ADA accessiblity standards for platforms at doorways with this configuration is 5 feet(60"). I wrote a letter denying the request for a waiver to allow a 10-foot(i think)deck to be installed under this provision. (My Wisconsin Commercial Building Inspector#is 70224.) He just stalling to see if we go away. He wants to know if there's any thing he can do short of removing 3 feet from the deck. Apparently his brother is paralysed and about 300 pounds and has to routinely be carried out by EMS. I didn't know whether there was any more latitude for a variance or anything else but said I would check with you. David R.
