2. Amendment to Easement Agreement. The Septic Easement shall be amended as <br /> follows: <br /> The easement area defined in the third "Whereas" clause of the Septic Easement is hereby <br /> modified and amended in whole. The new easement area shall be defined as that portion of the <br /> Golden Green Property that is legally described on Exhibit A, which is attached hereto and <br /> incorporated herein as though fully set forth. <br /> 3. Indemnification for Construction. Golden Green hereby indemnifies and holds <br /> Knipfer harmless from any and all damages or claims that arise out of the redevelopment of the <br /> Golden Green Property. <br /> 4. Rights to Run with the Land. The benefits and burdens of the Septic Easement, <br /> as amended herein, shall run with the land as appurtenances to the Golden Green Property and the <br /> Knipfer Property, and this Agreement shall be binding upon and inure to the benefit of the parties <br /> hereto and their respective heirs, personal representatives, successors and assigns. <br /> 5. Septic Easement. Unless specifically modified herein, all other terms and <br /> conditions of the Septic Easement shall be in full force and effect and shall continue to benefit and <br /> burden the Knipfer and the Golden Green Property as set forth therein. <br /> 6. Title to Golden Green Property. This Amendment shall run to and specifically <br /> bind Golden Green and its successors or assigns, including specifically Wisconsin Fuel LLC, <br /> which following redevelopment of the Golden Green Property,may hold title thereto. <br /> 7. Entire Agreement. This Amendment sets forth the entire understanding of the <br /> parties with regard to the Septic Agreement and any revisions thereto and may not be changed <br /> except by written document executed and acknowledged by all parties to this Amendment(or their <br /> successors and assigns) and duly recorded in the office of the Dane County Register of Deeds. <br /> [SIGNATURES ON NEXT PAGE] - <br /> 2 <br />
